header_5_text_color=&#8221;#000000&#8243; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p style=\"font-weight: 400;\"><strong>Mortgage inspection.<\/strong><br \/>Through this document, we can trace any mortgage registrations or encumbrances, such as foreclosure, that may burden the property.<\/p>\n<p style=\"font-weight: 400;\"><strong>Condominium regulations.<\/strong><br \/>In this document, we find the rules of the game, that is what\u2019s allowed and what\u2019s not.<\/p>\n<p style=\"font-weight: 400;\">It means, in some cases, confirming or denying the feasibility projects in which the potential buyer is interested, such as subdivision or change of use of the property that the regulations may prohibit and exclude.<\/p>\n<p style=\"font-weight: 400;\">Therefore, it is essential to carefully read the condominium regulations.<\/p>\n<p style=\"font-weight: 400;\">Another reading concerns the potential indebtedness of the potential seller, meaning knowing the amount of debt with the condominium and how many ordinary condominium fees are planned in the current year and the previous one.<\/p>\n<p style=\"font-weight: 400;\">Also, reading the latest condominium minutes allows us to close the circle and understand if any issues that need attention have arisen.<\/p>\n<p style=\"font-weight: 400;\">Last but not least, the resolutions of extraordinary expenses, a very delicate topic because it could (if not carefully verified) disrupt the investment plans of a potential buyer.<\/p>\n<p style=\"font-weight: 400;\">What is the risk of not conducting the necessary checks?<br \/>Buying a property, adding up all the costs between charges, notary, real estate mediation, taxes, and then discovering that extraordinary expenses with onerous amounts are recorded.<\/p>\n<p><strong>Letter Of Intent, (LOI).<\/strong><br \/>The transfer of a property is characterized by 3 negotiating phases preceding it: the purchase proposal, the preliminary contract, and the notarial deed of sale.<\/p>\n<p>(especially in cases of very complex negotiations) or where, due to documentary investigations, bureaucratic times should increase, and further time is necessary before formalizing an irrevocable purchase proposal, the LOI could come into play.<\/p>\n<p style=\"font-weight: 400;\">The LOI, therefore, is a bilateral pre-contract that represents a manifestation of intent in which there are no constraints if properly signed in form and content, except for the obligation of good faith. With the LOI, a strong interest in a particular operation is manifested.<br \/>Essentially, we are close to concluding the proposal between the parties, thus an agreement, but the final proposal has not yet been formalized. <\/p>\n<p><u>What it can contain:<\/u><\/p>\n<ul>\n<li>Property references,<\/li>\n<li>Parties (i.e., the data of the seller and the potential buyer),<\/li>\n<li>Agreements in principle,<\/li>\n<li>An estimate,<\/li>\n<li>The presumed payment method,<\/li>\n<li>The specification of why and what are the conditions that have not yet allowed the potential buyer to make a definitive offer.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong> <\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Contractual Elements<\/strong><br \/>These are essential and accessory elements.<br \/><u>Essential,<\/u> elements without which the contract does not exist; that is, it\u2019s automatically resolved:<\/p>\n<ul>\n<li>Will of the parties;<\/li>\n<li>Written form;<\/li>\n<li>Determined or determinable object;<\/li>\n<li>Price<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><u>Accessories<\/u>, all the other additional elements to the contract provided for by the Civil Code, such as conditional clauses, like suspensive or resolutive clauses.<\/p>\n<p style=\"font-weight: 400;\">The deposits, finally, complete the accessory elements, among these the most recurring are<br \/><em>the confirmatory deposit and the penalty deposit.<\/em><\/p>\n<p style=\"font-weight: 400;\">In the confirmatory deposit, there is the possibility of requesting greater damage and the fulfillment of the contractual relationship;<\/p>\n<p style=\"font-weight: 400;\">In the penalty deposit, this is not expected, as the amount is to be understood as a &#8220;flat rate&#8221;<\/p>\n<p style=\"font-weight: 400;\">of presumed damage while maintaining the right of bilateral withdrawal.<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\"><strong>Potential contractual \u201crisks\u201d<\/strong><br \/>Certainly the first, the most important one, is not to have planned every single step of the real estate operation well.<\/p>\n<p style=\"font-weight: 400;\">The second one, is the form of the preliminary contract.<br \/>An example is related to new constructions on a project or work in progress where the written form is that with a public deed.<br \/>Remember, therefore, when dealing with house builders, they must have signed and be compliant with:<\/p>\n<p style=\"font-weight: 400;\">&#8211; The obligation of sureties for the sums to be paid;<\/p>\n<p style=\"font-weight: 400;\">&#8211; The CAR Insurance on the construction site, a necessary and indispensable insurance contract for all construction companies that have an open construction site because it is used to protect the company from (direct) material damages suffered by the construction or by the people (the workers), more generally third parties, during the execution of construction work, and remember that it also ensures the property and equipment present on construction sites;<\/p>\n<p style=\"font-weight: 400;\">&#8211; The Decennial Liability Insurance at the time of the transfer of the property, an insurance policy that aims to indemnify the buyer of a building from damage to the property arising from defects that may arise in the 10 years following the date of completion of the works.<\/p>\n<p style=\"font-weight: 400;\">The CAR insurance and the Decennial Liability Insurance are both necessary and not alternative.<\/p>\n<p style=\"font-weight: 400; text-align: right;\"><strong><em>\u201cRisk can arise<br \/>only from not knowing<br \/>what you\u2019re doing.\u201d<\/em><\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.22.1&#8243; _module_preset=&#8221;fb3bde8f-2dbb-4eed-ab26-b71612ec8618&#8243; header_5_font=&#8221;Prata||||||||&#8221; header_5_text_color=&#8221;#000000&#8243; custom_padding=&#8221;||0px|||&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u201cThe results of our investments often aren\u2019t a result of market surprises, but of the choices we make.\u201dReal estate investmentWe find ourselves in a challenging macroeconomic context that requires versatility, patience, and a medium to long-term perspective, rich in opportunities especially in real estate-related debt.
